These Terms of Use ("Terms") govern your use of the Sandbar iOS application (the "App") and this website (together, the "Services"), operated by Sandbar ("we," "us"). By downloading or using the Services you agree to these Terms. If you don't agree, don't use the Services.

1. The Services

Sandbar provides fishing-related forecasts, conditions data, logging tools, and AI-assisted fish identification. The free plan includes a limited feature set; additional features require a paid Premium subscription.

3. Forecasts are estimates, not guarantees

Bite scores, forecasts, and conditions displays are estimates generated from third-party environmental data and predictive models. Fish do not read forecasts. We make no promise that any score, window, or recommendation will result in catching fish, and no promise that conditions data (including tide, wind, swell, and water temperature) is accurate, complete, or current.

Never rely on the App for safety decisions. Surf fishing involves real hazards including waves, currents, rocks, jetties, and weather. Conditions on the water can differ materially from any forecast. You are solely responsible for assessing conditions in person and for your own safety. If in doubt, don't go out.

4. AI fish identification

Fish ID results are AI-generated and can be wrong. They are provided for convenience and entertainment. Do not rely on fish ID results to determine whether a fish is legal to keep. You are solely responsible for correctly identifying your catch and complying with all applicable fishing regulations, including size limits, bag limits, seasons, and licensing, in your jurisdiction.

You keep ownership of the content you create in the App (catch logs, photos, notes). You grant us the limited license needed to process that content to operate the Services — for example, transmitting a photo to our providers to generate a fish ID result. We don't claim ownership of your catches, your photos, or your spots.

7. Intellectual property

The Services, including the Sandbar name, logo, design, and software, are owned by us or our licensors and are protected by law. These Terms don't grant you any right to use our branding.

8. Third-party data and services

The Services rely on third-party sources (such as NOAA data feeds) and providers (such as Apple for payments and AI providers for fish ID). We are not responsible for the availability or accuracy of third-party services, and their terms may apply to your use of them.

9. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FORECAST WILL BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING RELIANCE ON ANY FORECAST OR IDENTIFICATION RESULT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Termination

You can stop using the Services at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including 3, 4, 9, 10, and 13) survive.

12. Changes

We may update the Services and these Terms. For material changes, we'll provide notice in the App or on this site. Continued use after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of [YOUR STATE — SET BEFORE PUBLISHING], without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [YOUR COUNTY/STATE].
